Detailed rules About Some Advices to Accelerate Headquarters’ Economic Development (testing edition)

 

Chapter one General rules

Article one These detailed rules are formulated according to Some Advices to Accelerate Headquarters’ Economic Development (Shenzhen government, 2008,number 1)to encourage and promote headquarters’ economic development.

Article two Headquarter enterprises in these detailed rules is identified by established procedure according to Notice about Methods to Identify Headquarter Enterprises in Shenzhen (office of Shenzhen government, 2008, number 95).

Article three Headquarter enterprises can enjoy relevant preferential policies in these rules.

Article four The headquarters’ economic work joint meeting is a deliberative organ that city government makes policies about headquarters economic development of this city. Function of the joint meeting, rules of discussion and staff composition, etc. are regulated separately. The city development and reform office is responsible for routine of joint meeting.

Chapter two Special funds

Article five Overall consideration is given to special fund for headquarter economic development in present established special fund for industry development from the year 2008. Each district can arrange the special fund based on practical condition.

Article six The special fund for headquarter economic development is mainly used to reward enterprises at home and abroad to set up headquarters in this city, to subsidize newly established headquarter enterprises buying and renting office buildings in this city, to promote healthy development of enterprises and to launch necessary works identified by headquarter enterprises.

Article seven Management method to develop special fund for headquarter economy is formulated by the city development and reform office and the city finance office. Then it has to be approved by city government.

Chapter three Financial supports

Article eight Existing enterprise which is identified as headquarter enterprise in this city will be rewarded for five years’ subsidization. The reward amount is determined by the enterprise’s tax of last year (including income tax, turnover tax and value added tax, similarly hereinafter) and is 30% of the augmentation compared to last year. The newly established headquarter enterprise can enjoy this policy from the next year of its identification. During this period, if our country’s adjustment in policy of finance and tax leads to the change of enterprise tax paying, the reward amount should be adjusted with the same degree.

Article nine  The existing headquarter enterprise increasing capital more than 200 million yuan can enjoy a one-time reward according to the tax paid to the region government and the exact number is 50% of the augmentation compared to previous year. If the reward calculated based on this article exceeds the number calculated based on the Eight Article, it should be no more than 20 million. If the increasing capital is between 100 million and 200 million, headquarters can enjoy a one-time reward as above. If the reward number calculated based on this article exceeds the number calculated based on the Eight Article, it should be no more than 5 million yuan.

Article ten The newly established and identified headquarter enterprise will enjoy a one-time reward in the year when it is identified according to its category. The newly established comprehensive headquarter enterprise can enjoy no more than 20 million yuan and the newly established functional headquarter enterprise can enjoy no more than 5 million yuan. Specific reward amount is determined by the scale of headquarter enterprise, industrial development policy of this city and the existing subsidy policy of the industry it belongs to.

Article eleven The newly established and identified headquarter enterprise will enjoy a one-time subsidization for buying the office building (excluding auxiliary and assorted building) for its own use. The subsidization is one thousand yuan per square meter. Each comprehensive headquarter enterprise can enjoy a subsidization no more than 10 million yuan and each functional headquarter enterprise can enjoy no more than 5 million yuan. The subsidization will be paid 20 percent each year in five years’ time. 

Article twelve The newly established and identified headquarter enterprise will enjoy a one-time subsidization of twelve months for renting office building (excluding auxiliary and assorted building) for its own use. The subsidization is 30% of the guide price of rent market. If the price of renting office building is lower than the guide price of building rent market, the subsidization is 30% of the practical rent price. The subsidization will increase by 10% if the building is in Baoan or Longgang district. Comprehensive headquarter enterprise can enjoy a subsidization no more than 2 million yuan and functional headquarter enterprise can enjoy a subsidization no more than 1million yuan.

Specific operation method of financial subsidization is formulated separately by the city development and reform office and city finance and tax department and reported to the city headquarter economic work joint meeting.

Chapter four Headquarter land and plan

Article thirteen Basing on the city’s general plan and the plan of industry-gathering land, city government will make overall arrangement for headquarter base and arrange headquarter land relatively concentrated. Places agreeing with general plan and general economic development arrangement of our city and having many enterprise headquarters gather here can be regulated as headquarter base. Method of headquarter base management is formulated separately by industry authority.

Article fourteen Government can regulate relevant industrial headquarter functional areas, establish headquarter buildings and provide headquarter office buildings in preferential rent for the identified headquarter enterprise in headquarter base or areas gathered with industries. It also supports the headquarter enterprises with the same category or closely linked to construct headquarter buildings together.

Article fifteen Office land of headquarter enterprises is included in annual construction implementing plan and annual land supply plan of the short term. In every year’s supply of new land, a certain proportion of land is supplied in the way of biding and auction to meet the demand of office land of enterprise headquarter (excluding assorted or other land). If a headquarter enterprise obtains the land from government in the way of quoting, the area of its office building for its own use should be no less than 70% of the whole construction area.

Article sixteen Enterprises growing in Shenzhen and being identified as headquarter enterprises will be encouraged to use the obtained legal industrial land economically and increase utilization rate of land.

Chapter five Government service

Article seventeen Identified headquarter enterprise operating in a chain and setting up wholly owned or dominated dispatching center and store doesn’t have to conduct the process of business registration transferring and goes to business registration department directly to apply for registration.

Article eighteen  The city land and house property department arranges some talent apartments and public renting houses each year to solve the housing problem of the advanced staff and professionals of the headquarter.

Article nineteen  The city public security, personnel and labor department arrange certain norms each year to conduct household procedure for headquarter enterprise management staff meeting the standard and it is convenient for them to conduct procedures of family members’ movement and resident certificate.

Article twenty The city personnel, foreign affairs and public security department should deal with the application for going abroad for work of the city’s enterprise headquarter staff first, provide help when the hired foreign ordinary managing staff apply for one year’s resident approval and the advanced managing staff apply for one to five years’ resident approval and apply for Shenzhen and Hongkong plate numbers for headquarter enterprise actively.

Chapter six Management and adjustment

Article twenty one Headquarter enterprise can apply for and enjoy other preferential support policy of this city. But if financial support policy regulated in these detailed rules and other preferential policy are of the same category, only one of them can be enjoyed. Enterprise can select one of the preferential policy and can not change its selection in five years in principle.

Article twenty two The identified headquarter enterprise should send its statistic material of its condition to city statistic department each year.

Article twenty three  The headquarter enterprise should promise to operate in Shenzhen no fewer than 10 years and not to decrease registration capital in ten years after enjoying financial support and reward in these detailed rules.

Article twenty four Enterprise which obtains financial support and reward through deception and fraud, will be written into enterprise credit information files with its subsidization and reward repealed by city government. It is ordered to send back the subsidization and reward it once got. Enterprise which violates laws and regulations should be dealt with according to relevant laws and regulations

Article twenty five Each district can formulate corresponding policies based on these detailed rules and encourage to support headquarter enterprises.

Chapter seven Others

Article twenty six These detailed rules are interpreted by city government.

Article twenty seven These detailed rules are implemented from the releasing day.
